Murder Case

Mark and Jack were arrested with the charge of the murder of the youngster (police found them on the scene of crime). On the court Mark admitted the murder, saying that he shot him in the chest firing two bullets. Jack pleaded not guilty, because he tried (in vain) to stop Mark. After long deliberations, the jury found them both guilty, and sentenced them for life.
 
Why both, and not only Mark?

As such, the young and impressionable Mark mis-understood the comment, and shot the policeman chaisng them.
 
Clearly, Jack meant give him the gun and surrender; not shoot the pig.... Your Honour. Roll Eyes

Possibly because Mark, assuming that two bullets were found in the chest of the youngster, the bullets were shown by forensics to have come from different guns. Or, possibly, that more than two bullets were found Roll Eyes

Maybe Jack is a 20-year old marine, member of an elite force for special operations, and Mark is an old man who needs both hands just to lift the gun.
 
Or maybe Jack is Mark's father and as such is responsible for his actions.

Maybe Mark and Jack may have been in the act of committing a felony together, such as trying to rob a bank. Even though Jack may not have actually been the shooter or even made no attempt at directly trying to kill the victim, he can still be convicted of murder, if the victim died as a result of or during the commission of the felony.
 
Maybe in addition to the bullets, they found Jack's knife buried in the victim's back.  
 
Maybe Mark is blind, and since the victim was shot from across the room, Jack must have been the one who guided Mark in aiming the gun.

Very interesting read, T&B. Thanks for pointing out the real case.
 
I'm not sure how British law works, but in the USA, I believe that if the prosecution can show that a person could understand they were committing a felony (such as robbery in this case, if the amount attempting to steal was high enough to qualify it as a felony) then that person can be convicted of murder if anyone dies as a result of the commission of the felony, such as a person dying of a heart attack from fright or getting shot in a shootout with the police when they arrive.
 
Any lawyers out there?

There were actually two cases where this happened.  The second case was where Mark and Jack were conjoined (Siamese) twins.  
 
Although Jack was forced to be in jail with his post-op transgendered sister Mark (nee Marjorie), he was considered less guilty and received better food rations, conjugal visits, and exercise privileges.  
 
Mark had to wear a mouthguard when Jack was eating, a blindfold and earplugs when Jack was courting, and a hood when on walkabout in the prison yard.  As well, Mark's side of the mattress was lumpier and the sheets were attached only on Jack's side and would only cover half of Mark.  If I'm not mistaken, Mark's pillow was filled with 100 crushed lightbulbs from a previous sadistic jailer.
 
Jack had a sex change while in prison and changed his name to Jill.  Later, Jill's pregnancy springboarded the two of them to a minimum security prison where they easily escaped.  By applying their 'three legged race' winning technique from their many races as youths, they managed to lead the police to arrest Rolf Harris (http://www.rolfharris.com/photos/jake1.htm) which bought them enough time to get over the Mexican border and beyond.  They are now inmates of a Guatemalan insane asylum where they hand-pick "the merciless peppers of Quetzlzacatenango" (the Guatemalan Insanity Pepper), grown deep in the jungle primeval.
 
Authorities would storm the asylum were it not for the stories of several deadly DE's stragetically placed about the premises.  These Deadly Eclairs are each purported to contain one million calories, thirty pounds of butter per square inch, and chocolate so dark that light cannot escape.
 
Jill's baby Jessie (just turned 6 years old in June) seems to be growing up well-adjusted.  Jessie has yet to meet his uncle Mark because of Jill's belief that he would be a bad influence.

Did the thought cross anyone's mind that Mark and Jack are just split personalities? One was fighting to stop the other from surfacing and killing whoever it was that was to be killed...Like that movie with the guy, and that cracked out priest...I think his name was Roy...
