Two brothers are in a bar and one gets into a heated arguement and stabs the bartender to death despite the brother's attempts to stop him.

Later when he appeared in court with his brother for murder.  At the end of the trial the judge said, "You have been convicted of a vicious crime, however I have no choice but to let you go free."

Why is this?
