URGENT IRS REQUIREMENT
Notification to Foreign Teachers, Researchers & Students Claiming Tax
Treaties


TO: HRMS ADMINISTRATORS, DEPARTMENTAL ADMINISTRATIVE OFFICERS AND
ADMINISTRATIVE ASSISTANTS

RE: TAX TREATY EXEMPTION RENEWAL FOR CALENDAR YEAR 2005
DEADLINE: B DECEMBER 6, 2004


In order to continue claiming an exemption from federal income tax based on
an existing tax treaty in the calendar year 2005, the Internal Revenue
Service requires all eligible non-resident alien teachers, researchers, and
students to again complete the IRS form 8233 , tax treaty article for the
appropriate country, and a Certificate of Foreign Status (UC W-8BEN). B This
is required on an annual basis as long as you are claiming the tax treaty
benefit.


The three required forms can all be obtained on the UCOP website:
http://www.ucop.edu/ucophome/cao/paycoord/taxation.html or individually at
the following sites:


1) B Form 8233(December Rev. 2001)
http://www.irs.gov/ In the block "Search Forms and Publications for:"
enter 8233. B (Scroll down on the menu to find and download form
8233(December Rev. 2001). B There is an on-line fill-in form and data can be
entered and printed.)


2) B Tax Treaty Statement
 B http://www.ucop.edu/ucophome/cao/paycoord/taxstate.html (Click the
appropriate employee category & country to download)


3) B Certificate of Foreign Status for Federal Tax Withholding (UC W-8BEN)

Citizenship Status Form. B There is an on-line fill-in form and data can be
entered and printed.)


The HRMS Administrator and/or Payroll Assistant should verify with the
employee that these three forms are complete and return to Berkeley Payroll
Office, 171 University Hall no later than December 6, 2004. B  Non-compliance
and/or INCOMPLETE FORMS will result in loss of the exemption and
consequently federal taxes will be withheld until all requirements are met.
